Terms of Service for Trash Chat

Effective Date: May 16, 2025

Welcome to Trash Chat! These Terms of Service ("Terms") govern your access to and use of the Trash Chat website and its services (collectively, the "Service"). Please read these Terms carefully before using our Service.

By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not access or use the Service.

1. Description of Service

Trash Chat provides a platform for users to interact with an Artificial Intelligence (AI). The Service includes features that store and analyze these interactions to improve the AI's performance and user experience. The Service may offer both free and potentially paid features or tiers in the future.

2. User Accounts

  • To access certain features of the Service, you may be required to create an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.
  • You are responsible for safeguarding your password and for all activities that occur under your account, whether or not you have authorized such activities. You agree to notify us immediately at [email protected] of any unauthorized use of your account.
  • Trash Chat reserves the right to suspend or terminate your account at its sole discretion, including if any information provided during the registration process or thereafter proves to be inaccurate, not current, or incomplete, or if you violate these Terms.

3. User Conduct

By using the Service, you agree not to:

  • Use the Service for any illegal, fraudulent, or unauthorized purpose.
  • Submit, transmit, or cause to be transmitted any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, libelous, invasive of another's privacy, hateful, or racially, ethnically, or otherwise objectionable, or that infringes any third party's intellectual property rights.
  • Attempt to gain unauthorized access to, interfere with, damage, or disrupt any parts of the Service, the server on which the Service is stored, or any server, computer, or database connected to the Service.
  • Upload or transmit viruses, worms, Trojan horses, or other malicious or technologically harmful code.
  • Collect or harvest any personally identifiable information, including account names, from the Service without permission.
  • Use the Service for any commercial solicitation purposes unless expressly permitted by Trash Chat.
  • Impersonate another person or otherwise misrepresent your affiliation with a person or entity.
  • Interfere with the proper working of the Service or bypass any measures we may use to prevent or restrict access to the Service.
  • Use any robot, spider, or other automatic device, process, or means to access the Service for any purpose, including monitoring or copying any of the material on the Service, without our prior written consent.
  • Reverse engineer, decompile, disassemble, or otherwise attempt to discover the source code or underlying ideas or algorithms of the Service, except to the extent that applicable law expressly prohibits such a restriction.

4. Content and Intellectual Property

  • Your Content: You retain ownership of the content of your interactions with the AI on our platform ("User Content"). By submitting User Content, you grant Trash Chat a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform your User Content in connection with operating, providing, and improving the Service. This includes, but is not limited to, using User Content for AI training and development, and sharing interaction data with our AI service provider as described in our Privacy Policy. You represent and warrant that you have all necessary rights to grant us this license for any User Content you submit.
  • Our Content: The Service and its original content (excluding User Content), features, and functionality are and will remain the exclusive property of Trash Chat and its licensors. The Service is protected by copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws of [Specify Company's Country/Region, e.g., the United States] and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Trash Chat.
  • AI Output: You acknowledge that interactions with the AI are for informational and entertainment purposes. While we strive for accuracy and usefulness, Trash Chat makes no warranties or representations regarding the accuracy, reliability, completeness, or appropriateness of any information or output provided by the AI ("AI Output"). You are solely responsible for your use of and reliance on any AI Output. AI Output may be subject to third-party rights or licenses, and you agree to comply with any such applicable terms.
  • Feedback: If you provide us with any suggestions, comments, or other feedback relating to the Service ("Feedback"), such Feedback will be the sole and exclusive property of Trash Chat. You hereby assign to Trash Chat all of your right, title, and interest in and to such Feedback.

5. Privacy and Data Use

Our collection and use of your personal information are described in our Privacy Policy, which is incorporated by reference into these Terms. By using the Service, you consent to our collection, use, and sharing of your information as set forth in the Privacy Policy, including the use of cookies and the sharing of interaction data with our AI service provider.

6. Fees and Payment (If Applicable)

Some parts of the Service may be subject to fees. If you subscribe to any fee-based services, you agree to pay all applicable fees as described on the Service for those services. All fees are non-refundable except as expressly stated in our Refund Policy below or as required by applicable law. We reserve the right to change our prices and to institute new charges at any time upon notice to you, which may be sent by email or posted on the Service. Your continued use of the fee-based services after such notification constitutes your agreement to any new or increased charges.

7. Refund Policy (If Applicable)

  • General: This refund policy applies to any paid services offered by Trash Chat.
  • Subscription Services: For subscription-based services, refunds are generally not provided for the current subscription period. You may cancel your subscription at any time, and your cancellation will take effect at the end of the current billing cycle. You will continue to have access to the service until the end of your billing period.
  • One-Time Purchases: For any one-time purchases of services or digital content, refunds will be considered on a case-by-case basis and granted at the sole discretion of Trash Chat, unless otherwise required by law. To request a refund, please contact us at [email protected] with your purchase details and reason for the request within fourteen (14) days of purchase.
  • Exceptions: We may offer refunds in specific situations if a service is not delivered as described or is faulty, in accordance with applicable consumer protection laws.
  • No Refunds for Violation of Terms: No refunds will be issued if your access to the Service is terminated due to a violation of these Terms of Service.
  • Changes: This refund policy is subject to change, and any changes will be posted within these Terms of Service.

8. Data Security

We implement reasonable security measures designed to protect your information. However, you acknowledge that no method of transmission over the Internet or method of electronic storage is completely secure, and we cannot guarantee absolute security. You provide your information at your own risk.

9. Termination

  • We may terminate or suspend your access to our Service immediately, without prior notice or liability, for any reason whatsoever, including, without limitation, if you breach these Terms.
  • Upon termination, your right to use the Service will immediately cease. All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.

TRASH CHAT, ITS SUBSIDIARIES, AFFILIATES, AND ITS LICENSORS DO NOT WARRANT THAT: A) THE SERVICE WILL FUNCTION UNINTERRUPTED, SECURELY, OR BE AVAILABLE AT ANY PARTICULAR TIME OR LOCATION; B) ANY ERRORS OR DEFECTS WILL BE CORRECTED; C) THE SERVICE IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS; OR D) THE RESULTS OF USING THE SERVICE (INCLUDING AI OUTPUTS) WILL MEET YOUR REQUIREMENTS OR BE ACCURATE, RELIABLE, OR COMPLETE. YOUR USE OF THE SERVICE AND ANY AI OUTPUT IS AT YOUR SOLE RISK.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL TRASH CHAT, ITS AFFILIATES, DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, REVENUE, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (I) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; (II) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE; (III) ANY CONTENT OR AI OUTPUT OBTAINED FROM THE SERVICE; (IV) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT; OR (V) ANY OTHER MATTER RELATING TO THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STATUTE, OR ANY OTHER LEGAL THEORY, WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE, AND EVEN IF A REMEDY SET FORTH HEREIN IS FOUND TO HAVE FAILED OF ITS ESSENTIAL PURPOSE.

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE USE OF OR ANY INABILITY TO USE ANY PORTION OF THE SERVICE OR OTHERWISE ARISING OUT OF OR RELATING TO THESE TERMS, WHETHER IN CONTRACT, TORT, OR OTHERWISE, IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU HAVE PAID TO TRASH CHAT FOR ACCESS TO AND USE OF THE SERVICE IN THE TWELVE (12) MONTHS PRIOR TO THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100), IF YOU HAVE NOT HAD ANY PAYMENT OBLIGATIONS TO TRASH CHAT, AS APPLICABLE.

12. Indemnification

You agree to defend, indemnify, and hold harmless Trash Chat and its licensee and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of: (a) your use and access of the Service, by you or any person using your account and password; (b) a breach of these Terms; or (c) User Content you submit to the Service.

13. Governing Law

These Terms shall be governed and construed in accordance with the laws of Turkey, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms, together with our Privacy Policy, constitute the entire agreement between us regarding our Service and supersede and replace any prior agreements we might have had between us regarding the Service.

14. Dispute Resolution

Any disputes arising out of or relating to these Terms or the Service shall be resolved through amicable negotiations. If a dispute cannot be resolved through negotiation within thirty (30) days, such dispute shall be submitted to binding arbitration in [Specify City, State/Country for Arbitration] under the rules of [Specify Arbitration Association, e.g., the American Arbitration Association]. The language of the arbitration shall be English. This arbitration agreement will survive the termination of your relationship with Trash Chat.

15. Changes to These Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will make reasonable efforts to provide at least thirty (30) days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. We will notify you of any changes by posting the new Terms on this page and updating the "Effective Date" at the top.

By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you must stop using the Service. It is your responsibility to review these Terms periodically for any updates or changes.
